DECISION & ORDER ON MOTION

Motion by the appellant on an appeal from an order of the Supreme Court, Suffolk County, dated May 12, 2005, to stay enforcement of so much of the order as precluded him from offering any testimony with respect to certain issues and directed that he pay an attorney's fee in the sum of $3,120, pending hearing and determination of an appeal from the order.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is granted, and enforcement of so much of the order as precluded the appellant from offering any testimony with respect to certain issues, and directed the appellant to pay an attorney's fee in the sum of $3,120, is stayed, pending hearing and determination of the appeal on condition that the appellant perfect the appeal on or before July 26, 2005; and it is further,

ORDERED that on the court's own motion, the trial in the above-entitled action is stayed, pending hearing and determination of the appeal; and it is further,

ORDERED that in the event the appeal is not perfected on or before July 26, 2005, the court, on its own motion, may vacate the stay, or the respondent may move to vacate the stay, on three days notice.

Motion by the appellants for leave to prosecute an appeal from an order of the Family Court, Suffolk County, dated January 3, 2005, as a poor person, and for the assignment of counsel.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is granted; and it is further,

ORDERED that the appeal will be heard on the original papers (including a certified transcript of the proceedings, if any) and on the briefs of the appellants, the respondent, and the Law Guardian, if any. The parties are directed to file nine copies of their respective briefs and to serve one copy on each other (22 NYCRR 670.9[d][1][ii]; Family Ct Act § 1116); and it is further,

ORDERED that the stenographer(s) and/or the transcription service(s) is/are required promptly to make and certify two transcripts of the proceedings, if any, except for those m intues previously transcribed and certified (22 NYCRR 671.9); in the case of stenographers, both transcripts shall be filed with the clerk of the Family Court, and the clerk of the Family Court shall furnish one of such certified transcripts to the appellants counsel, without charge; in the case of transcription services, one transcript shall be filed with the clerk of the Family Court and one transcript shall be delivered to the assigned counsel. DECISION & ORDER ON MOTION

Motion by the petitioner-respondent pro se, inter alia, to waive the motion filing fee and to enlarge the time to serve and file a brief on an appeal from an order of the Supreme Court, Kings County, dated June 8, 2004.

Upon the papers filed in support of the motion and no papers having been filed in opposition or relation thereto, it is

ORDERED that the branch of the motion which is to waive the motion filing fee is granted; and it is further,

ORDERED that the branch of the motion which is to enlarge the time to serve and file a brief is granted and the petitioner-respondent's time to serve and file a brief is enlarged until August 15, 2005, and the petitioner-respondent's brief must be served and filed on or before that date; and it is further,

ORDERED that the motion is otherwise denied.

Motion by the appellant on an appeal from a judgment of the County Court, Westchester County, rendered October 23, 2003, for leave to serve and file a supplemental brief raising issues based on the holding of People v Caserta (19 NY2d 18).

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is granted; and it is further,

ORDERED that the appellant shall serve and file a supplemental brief raising issues based on the holding of People v Caserta (19 NY2d 18) on or before July 18, 2005; the respondent shall serve and file a brief in response on or before August 8, 2005; and the appellant, if he be so advised, may serve and file a reply brief on or before August 18, 2005.

DECISION & ORDER ON MOTION

Appeal by James Williams from an order of the Supreme Court, Kings County, dated April 18, 2003. By order to show cause dated May 4, 2005, the appellant was directed to show cause before this court why an order should or should not be made and entered dismissing the appeal in the above-entitled proceeding as abandoned.

Now, on the court's own motion, and the papers filed in response to the order to show cause, it is

ORDERED that the motion is denied; and it is further,

ORDERED that on or before September 26, 2005, the appellant shall either make a motion for poor person relief or perfect the appeal by causing the original papers constituting the record on the appeal to be filed in the office of the Clerk of this court (see 22 NYCRR 670.9[d][2]) and by serving and filing his brief on the appeal.
