The respondent was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on March 18, 1998.

By subsequent decision and order of this court dated May 7, 2001, his motion for leave to reargue was granted and, upon reargument, his application for reinstatement was denied with leave to renew upon the submission of (1) a completed copy of the questionnaire required of all disbarred, suspended, and resigned attorneys, (2) a copy of his affidavit of compliance, and (3) proof of service of the application for reinstatement on the Lawyers' Fund for Client Protection. By further decision and order of this court dated November 1, 2001, this renewed application was held in abeyance, and the matter was referred to the Committee on Character and Fitness to investigate and report on his current fitness to be an attorney.
