How to Proceed When a Loved One Dies

 

The Surrogate's Court maintains jurisdiction over all actions and proceedings relating to the affairs of decedents. This includes the probate of wills ( testate) and administration of estates ( intestate).

Type of Proceedings:

Probate - Decedent Left a Will (and estate assets of more than $30,000.00)
Administration - Decedent did NOT leave a Will (and estate assets of more than $30,000.00)
Voluntary Administration / Small Estate Affidavit Program - For estates with assets less than $30,000.00 (with or without a will)
