Alternate Dispute Resolution Program Overview

The Commercial Division operates an alternative dispute resolution program for cases assigned to the Commercial Division and appropriate cases outside it. Cases may be referred to the Program upon the consent of the parties or at the direction of the Justice assigned. The Program will provide any form of ADR the parties wish.  Absent a choice by the parties, the process will be mediation. The ADR Rules set forth the procedures to be followed, including deadlines. The Program is explained in detail in the Guide to the Alternative Dispute Resolution Program. The Roster of Neutrals of the Program contains the names of some 250 neutrals who have agreed to participate in the Program.
