Free CLE GAL Workshop: Nuts and Bolts of Non-primary Residence Holdovers

Typically, a rent-stabilized tenant cannot maintain their apartment if they live elsewhere for a substantial amount of time. These situations can become complicated when, for example, an elderly person is admitted to a nursing home for an illness but seeks to return to his rent-stabilized apartment later. This workshop will cover "non-primary residence holdovers"—the common type of housing cases landlords commence to evict a tenant who does not live in his or her rent-stabilized apartment primarily. We will discuss: (i) what is a non-primary residence holdover?; (ii) what procedures must a landlord follow when commencing a non-primary residence holdover?; (iii) what factors does the Housing Court consider when hearing a non-primary residence holdover case?; (iv) what are important exceptions for rent-stabilized tenants who live elsewhere but seek to maintain their rent-stabilized apartment?
